Welcome to Garden Landscape Gardeners. These Terms and Conditions govern your use of our services and outline the rights and obligations of both parties. By engaging our services, you agree to comply with and be bound by the following terms.

1. Definitions

Client: The individual or entity engaging our landscaping services.
Services: All gardening and landscaping activities provided by Garden Landscape Gardeners.
Agreement: The contractual terms between the Client and Garden Landscape Gardeners.

2. Services Offered

Garden Landscape Gardeners provides a comprehensive range of landscaping services, including but not limited to:

Design and Planning: Creating customized landscape designs tailored to the Client's preferences.
Installation: Implementation of landscape designs, including planting, hardscaping, and irrigation systems.
Maintenance: Regular upkeep services such as mowing, pruning, and fertilizing.
Consultation: Expert advice on garden improvement and sustainability practices.

3. Client Responsibilities

The Client agrees to:

Provide Accurate Information: Supply all necessary information regarding the project requirements, site conditions, and desired outcomes.
Access to Property: Ensure Garden Landscape Gardeners has appropriate access to the property during the project duration.
Timely Payments: Adhere to the payment schedule outlined in the Agreement.
Permits and Approvals: Obtain any necessary permits or approvals required for the landscaping project.

4. Payment Terms

Fees and Charges: The Client agrees to pay the fees as specified in the Agreement. Fees may vary based on the scope of work, materials used, and project complexity.

Payment Schedule: Payments are to be made according to the following schedule:

Initial Deposit: 30% upon signing the Agreement.
Progress Payment: 40% upon completion of 50% of the project.
Final Payment: 30% upon project completion and Client approval.

Late Payments: Late payments may be subject to interest charges and could result in project delays.

5. Cancellation and Termination

The Client may terminate the Agreement under the following conditions:

Mutual Agreement: Both parties agree to terminate the contract.
Material Breach: If either party fails to fulfill their obligations as outlined in the Agreement.
Force Majeure: Unforeseen events beyond control, such as natural disasters, that prevent project continuation.

In the event of termination, the Client is responsible for paying for all services rendered up to the termination date.

6. Liability

Garden Landscape Gardeners ensures the highest standards of work; however, we are not liable for:

Damages resulting from pre-existing conditions not identified before project commencement.
Natural occurrences such as extreme weather affecting project outcomes.
Third-party actions or negligence impacting the project.

Our liability is limited to the total fees paid for the specific project.

7. Warranties

We provide warranties on our workmanship and materials used. If defects arise within the warranty period, we commit to repairing or replacing the affected parts without additional cost, provided the Client notifies us within the specified timeframe.

8. Dispute Resolution

In the event of a dispute, both parties agree to:

Negotiation: Attempt to resolve the matter amicably through direct communication.
Mediation: Engage a neutral third party to facilitate a mutually acceptable resolution.
Arbitration: If mediation fails, proceed to binding arbitration as per the relevant laws.

Legal actions should be a last resort after all other resolution methods have been exhausted.

9. Intellectual Property

All designs, plans, and proprietary materials developed by Garden Landscape Gardeners remain the intellectual property of the company. The Client is granted a limited license to use these materials solely for the purpose of the agreed-upon project.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Garden Landscape Gardeners operates. Any legal actions arising from these terms will be subject to the exclusive jurisdiction of the local courts.

11. Amendments

Garden Landscape Gardeners reserves the right to amend these Terms and Conditions at any time. Clients will be notified of significant changes, and continued use of our services constitutes acceptance of the updated terms.

12. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms and Conditions constitute the entire agreement between the Client and Garden Landscape Gardeners, superseding any prior agreements or understandings, whether written or oral.

14. Acceptance

By engaging the services of Garden Landscape Gardeners, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
